YOUR USE OF PHOTODISC(tm) IMAGES ON THIS SPECIAL PROMOTION DISC
End User License
PhotoDisc images are licensed with the user in mind. We aim to maximize your use of the images and to minimize confusion about how they may be used. We encourage you to use these PhotoDisc images in projects such as creative design, advertising, and titles for sale. These uses are detailed below.
THIS IS A LEGAL AGREEMENT BETWEEN YOU AND PHOTODISC, INC. BY ACCESSING THE PHOTODISC IMAGES ON THIS SPECIAL PROMOTIONAL DISC YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.
GRANT OF LICENSE. PhotoDisc grants you the nonexclusive, nonassignable right to install and use the PhotoDisc images and any derivatives or copies thereof (collectively, the "Images") on this disc on one computer and with one user at a time. The Images may be copied, modified and incorporated in materials in accordance with the following provisions:
(1) Personal Use. You may make copies of the Images, in digital or printed form, for personal or internal company use. For example, internal presentations and brochures.
(2) Advertising and Promotion. You may make copies of the Images, in digital or printed form, for use in advertising or promotional materials for you or your clients.
Any use of the Images not explicitly granted by this agreement is prohibited. If you wish to use the Images in television programming, cable programming, motion pictures, or wide area networks, you must first obtain additional licensing from PhotoDisc. Pornographic use of the Images is prohibited. Except as specifically permitted above, you may not copy this disc.
ADDITONAL RIGHTS AVAILABLE. If you are unsure of your rights under this agreement or wish to secure additional license rights, please contact PhotoDisc for information. We have licensing options available that are easy to understand and designed to meet your needs.
TRADEMARK. PhotoDisc(tm) is the (the "Trademark") trademark of PhotoDisc, Inc. You may only use the Trademark as part of a credit or copyright notice in connection with the use of the Images. All other use of the Trademark is prohibited.
WARRANTIES. PhotoDisc warrants that it has the right to grant this license to you. EXCEPT AS PROVIDED ABOVE, PHOTODISC AN ITS SUPPLIERS MAKE NO WARRANTIES EXPRESS OR IPLIED WITH RESPECT TO THE SOFTWARE, THE IMAGES OR THE TRADEMARKS, INCLUDING, WITHOUT LIMITATION, AS TO NON-INFRINGEMENT OR THIRD PARTY RIGHES, MERCHANTABILITY, OR FITNESS FOR NAY PARTICULAR PURPPOSE. IN NO EVENT WILL PHOTODISC OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF REPRESENTATIVES OF SUCH PARTIES HAVE BEEN ADVISED OF THE POSSIBILITYOF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. Some state or jurisdictions do not allow the exclusion or limitation of incidental, consequential, or special damages, so the above limitations and exclusion of implied warranties, so the above limitations may not apply to you. To the extent permissible, any implied warranties are limited to ninety(90) days. This warranty gives you specific legal rights. You may have other rights which vary from state to state or jurisdiction to jurisdiction.
GENERAL
The software and the Images are protected by the United States copyright laws, international treaty provisions and other applicable laws. You may be held legal responsible for any failure to abide by the terms of this agreement. PhotoDisc and its suppliers retain all rights not expressly granted by this agreement. This disc is licensed only to you. The license granted under this agreement may not be transferred without the prior written consent of PhotoDisc and will terminate automatically without notice from PhotoDisc if you fail to comply with any provision of this agreement. Upon termination, you must stop using the disc, the Images and the Trademarks and must return the disc and all copies of it to PhotoDisc immediately.
